San Diego Superior Court Case Number 769191. Defended a complex insurance broker/agent liability action alleging breach of oral contract, professional negligence, and fraud. This matter arose from an underlying unlawful termination and discrimination case filed against CPS Printing. There were several causes of action alleged in the underlying discrimination case, but only one was potentially covered under the insurance policies CPS Printing elected to purchase. However, no defense of the underlying action was provided by any of CPS Printers' carriers due to a change in the policy form during the insurance renewal process that our client allegedly failed to recognize, resulting in a gap in coverage. Our thorough and effective representation resulted in a complete dismissal of the fraud claim and a very favorable jury verdict for the client.

The insured brought an action against the insurer for a declaratory judgment on the insurer's duty to defend and indemnify the insured under its business owners' and umbrella policies. The Superior Court entered a summary judgment in favor of the insurer. The Court of Appeal affirmed, holding that the need to show prejudice from late notice was bound by New York law; that the insured's 58-day delay in notifying the insurer of the claim was unreasonable; that the insurer could consider the extrinsic evidence of the insured's retention of defense counsel when denying coverage for late notice of claim; and finally, that the insurer's two-month delay in sending a disclaimer letter did not estop it from denying coverage to the insured.

Plaintiff was employed by the defendant as a supervisor at a residential site. After having difficulty with a subordinate with serious behavioral problems, plaintiff was terminated for a variety of reasons, including the failure to deal with the troubled subordinate. Plaintiff sued defendant alleging wrongful termination. Defendant moved for summary judgment and it was granted by the trial court. The Court of Appeal affirmed, holding that the plaintiff did not present evidence from which a trier of fact could reasonably infer a causal link between the plaintiff's protected activity and the termination of the plaintiff's employment.
